How Immigrate France-Separted with EEA national

I am separated with British national, currently i am living in India (don't have British passport or leave to remain) with my two children who are British nationals. I want to settle in France. Can someone advice me that how can I exercise EU treaty rule. I also haven been told that I have be self sufficient in France, should know French, need regular income coming from my resources, need sponsor in France and also need close ties i.e some one from by blood relation would be living in France. I am bit confused. Can some one help me. many Thanks

So you are living in India with your two British children (wife is no longer in the picture, though you are not yet divorced).

And you want to move to France? Do you need to work or are you self sufficient?

I am not yet divorced. I don’t know what is the option available for me. But I think I will go for self sufficient. Can you tell me what are the rules for self sufficient. There is another problem that I have read in the directive that I need my ex partner permission to take children with me I don’t know how to over come this problem because I have no contact with him and even I contact him he will not allow to take children with me.

Do you definitely want to go to France? Is so you should think of a Chen ruling residence. You would need to be financially self sufficient, and could not work.

If you want to go to the UK, then you could think of a Zambrano ruling residence. In this case you can work.

In both cases your children would be with you.

Do you presently have any European visas or residence permits? And in which country is your separated spouse?

Hi Guru,

My separated spouse is a British national. He is currently living in the UK. This is the reason that I don’t want to come to the UK. I had two year British fiancé visa which has now been expired. This visa was an entry clearance visa which was issued when I got married.
Can you advice me what are the rules for self sufficient visa for France and what are the requirements.

I do not know how France implements it, but the EC ruling applies in all EU member states.

I have no idea for the french. You can read about the UK requirements on the UKBA web site, and it should be similar for France.
