Eligibility to British citizenship

Post by accastudent84 » Sat Sep 17, 2011 8:10 pm

hi

i hope all of u doing well i just got few questions and need answers can some 1 pls help
my question is i got ILR just few days ago on the bassis of my marriage to a british citizen altough i am in uk from 2004 on student visa till sep2009 when i got married to my wife and got spouse visa so here is what will make it more clearer to u guy s

2004 - 2009 student visa
2009 - 2011 spouse visa
sep 2011 ILR (marriage base)

question#1: for naturalisation as a british citizen requires 3 years residentship does my student visa status fulfills that as u could see i was on student visa one year before my marriage ,and i want to make it clear , yes i was physically in the uk

2nd question# Alot of solicitors nearlly all of them say you have to spent 12 months on ilr before u could apply for ur naturalisation but home office web site says as a spouse of british citizen u must hold ilr at the time of your application and dont mention 12 months in this category i know alot of ppl will refer to home office web site but does some one actually in the same situation as me or been in the same situation as me ?as i already read home office site but i need a practical answer to that

all of ur kind help will be really appreciated .thanks to all for taking ur time and read .

I guess you meant to write "For naturalisation as "spouse of British citizen" requires 3 years ....."
Yes, time in UK as a student (or for that matter any "lawful' stay) can be counted in the "3 years" in question.

Apply on Monday, if you wish to.

It doesn't apply to you. Make sure however, that you were physically present in the UK 3 years previously to the date you submit your application.
i.e application 19/09/11 - present in the UK 19/09/08.
Neither can you have been out of the country on that date on holiday.
