she has Mexican passport.
she lived in Spain before coming to the UK with her Belgian husband.
she also has Spanish residence. she applied Spanish Nationality 1 year ago, but it'll take 1 more year to get it (she already has an appointment on Sep of 2012).

she came to the UK one month ago, her husband is working in Spain till Feb 2012, then he will come to the UK.

she is not sure she needs the visa.

To be able to reside legally in the UK, her Belgian husband needs to live in the UK until then she can only visit the UK as a tourist.

She isn't Spanish yet!

What "visa" could she apply for?

How did she enter the UK? Alone as a visitor or together with her husband?

thanks vinny and 86ti,
she went to the spanish embasy yesterday.
they told her she needed to apply a visa because she is not spanish yet like you said,,,

she entered to the uk with her husband just to study english for few weeks but they liked the uk they decided to stay.
as he had a job in spain he went back to spain.

thanks for your answer.
she'll go back to spain to apply the visa.

This is a very confusing story! What visa is she thinking of applying for, from whom, and where?

How far away from Spanish citizenship is she? If she is close, it would make a lot of sense to finish that off before moving to the UK

She might technically be able to remain in the UK for up to 3 months on her own, but that is problematic and it is likely better if she is back in Spain until they both move to the UK.
