Yeah got a little girl, all family here and have been for 25yrs. Am living at home as mom poorly, its tough as i can't provide for my daughter,i did once when she was born for 3yrs but got stitched and got caught so can't do it again.,however hard its been or is i will wait as i have been given a second chance. What about you?, how you managing.

well because am using legal aid, she is applying for funding now. So we can lodge the case with the court and she has already spoken to a barrister now to take on the case

Yeah i'm using legal aid as well but i did fill in all the forms a while now but tried to call the solicitors yesterday to update me on what we gan do next,but it seemed more frustrating for me but contacted my MP again so waiting on that as well.if you have a criminal record do they take this long or play games to frustrate you into crime.i don't know,what do you think?.

I wish I wish you guys all the best . I hv a pending article 8 claim as well, just been here more than 8 yrs with two lkids ages 6 and 3 thou none is british.I know someone tht has just been granted dlr after pre action protocol letter.let us hope for the best its very fustrating, but wht can we do.cheers

Hi Joejo, just got a call from my solicitor and my application was refused on the grounds of the criminal record i got by working illegally. I have a right of appeal and she is getting everything ready for the 1st tier tribunal. Am sorting out my character references now.Hope you hear good news soon

Hey net5
I haven't heard anything yet,its not the best of news from your end but you can build on that for some it positive result thou the struggle continues.Going to court is some tyms the best way to break out of this limbo.however now you need to get all ya evidence together as in your claim to back you up that's what court is interested in. like letters from your family and friends,even their presence of support when you go for hearing, ties to your community everything that will strengthen you case in court under act 8. Ask your solicitor as well for what you may need to put in.When did you fin your sentence,when did you file for the JR.From time of reconsideration how long has it taken.

my inital application was made in 2010 and i was refused i have a pending reconsideration with them i hv waited for about 4 months.
@nets5 hope it all goes well with the appeal did they give u removal diections?

so wen it was refused did you go to court like net5 going through now,do you have a criminal record, I've been waiting now two yrs since they said to reconsider my case. but lets all be strong for ourselves.

i just spoke to my solicitor today over the phone and she didn't mention anything about removal directions. I am meeting her tomorrow so i can provide more information then

So what did she advice as the next step,do you have close family living here permanently. my solicitors rang me yesterday as a matter of urgency so i went and they said that since the HO ignored their deadline of the 4th Aug till today without responding they are going to apply for funding for JR so i did sign the forms,just waiting to see whats going to happen next,Hey lets all who are waiting and struggling be positive all be OK, lets just have the all the way spirit.

Hi guys
has anyone in a similar situation as my case in previous threads or known to someone who has waited for 2yrs with MP's support, threaten JR and still been ignored by HO,Then probably succeeded out of limbo,but waiting for funding legal aid to lodge in for a JR. Please share some known stories am losing ma mind.will be so grateful.

no news buddie am losing mi head, mi solicitor applied for funding don't no when that's coming through its nearly 30 working days but they reckon prob next week at latest. HO ignored their deadline up to now,nothing they just shut it, next week be 2mnths since.so we need to file for JR as it should be done within 3mnths, may be that's what they waiting for. That's great from your side court is just black and white paper to pen, if you prepared all ya evidence to support ya claim don't worry it will be ok fingers crossed. with merits judges look into all.

just to update you, i got my determination last week and my appeal was allowed on art 8 private life, home office has 2 days left now to appeal if they want but my barrister said he doesn't see them doing that.

Hey
that sounds good i pray it all goes well, I've not heard a thing yet.we've applied for funding but that seems to take forever as well next step is JR now hopefully by the end of this month.Solicitor reckons all be done by December fingers crossed.So what be your next move after the two days?.

wait for my call letter from the ho about issuing status documents for me which i have been told can take up to 8 weeks which i don't mind waiting for. Then get my life back on track, fingers cross that you hear something soon.

Hi Guys
Just got refusal letter from HO. Applied under Art8. Apply on time before leave to remain expired but the HO said i applied after it was expired. Did consult a lawyer , he will lodge the pre-action protocol for me before the JR.
Having read the forum here ' its give me a ray of sunshine'.
Joejo, how is your JR, hope everything is ok
