I am on Tier 1 and need to switch to Tier 1 dependant

Post by meetakhan » Wed Sep 28, 2011 12:27 am

Hi
I need your help with respect to my situation.

I am currently on Tier 1 (general) visa. I obtained it in Feb 2009 and it is expiring in Feb 2012. I got married in July 2011 in UK and my husband is also on Tier 1 (general) due for renewal in November 2011.
I am not working since June 2011 and hence I will not be eligible to renew my Tier 1 in Feb 2012. I believe I can stay in UK as my husband's dependant once his visa is renewed in Nov 2011.
I have tried to find the info regarding my situation on UKBA website but could not find something relevant to my situation.
Can someone help and guide me in this situation? My marriage is registered in UK and I have marriage certificate and wedding pictures to support my application.
It would be highly appreciated if someone can throw some light on how to switch from Tier 1 (general) main applicant to Tier 1 (general) dependant and if I have to inform UKBA regrarding my change of circumstances?

Many Thanks,
Meeta

You can't switch from inside the UK. You will have to leave and apply for a visa from your home country.

Can't I apply along with him from UK

Hi Lookapuca,

Thanks for replying.

I was wondering if I can apply from within UK along with his renewal application form of Tier 1 (general)?

Also what are the documents required if I apply from my home country delhi? Are you aware of the timelines of such renewal in general?

Regards,
Meeta

The only way you can avoid a trip to India is if you continue with your current independent status. Otherwise, if you want to be your partner's dependant family member, you are obliged to apply from outside the UK. If you wanted to apply with your parnter from inside the UK (when he applies to extend) it could only be on the basis that you have existing leave as a PBS dependant. You do not have that status so are not eligible.

A big thanks to Lucapuca and Sush. You both are stars!!

Thanks for providing the links to relevant info. I have concluded the following after reading the links you sent earlier:

- I have to go back to India in order to switch to PBS dependant and apply for dependant visa.
- I need to apply for dependant visa using VAF10 form along with following supporting documents:
1. Marriage certificate
2. Sponsor/cover letter from my husband
3. Copy of his passposrt with his Tier 1 visa page
4. Either mine or his bank statements of atleast last 3 months showing the required maintainence funds. In my case he is in UK for over 12 months and hence needs to show £533 * 3 = £1599
5. One passport size photograph

If you feel I have missed something above, please let me know.

All your help is really appreciated. I mean it
:D

Thanks,
Meeta

It's not 533 for each month; it's 533 over three a three month period. You need only 533.
