TIER 1 GENERAL DEPENDENT can stay out of UK for how long ?

Post by hj_vortex » Wed Sep 28, 2011 11:17 am

Hi guys my freind who is on a TIER 1 general second extention visa now (only got 2 years to go for ILR now) ... his wife (dependent tier 1 general visa) is going to pakistan for a stay more then 90 days

my question is .. WILL THAT AFFECT the future ILR APPLICATION ?? the main applicant ( my freind) is staying in UK and will not go to pakistan at all but just worried if his wife overstays can affect the ILR Application or not ?

No affect on settlement of the dependant (or the main migrant), as dependant's absences from UK are irrelevant.

No need to confirm this. ILR of the dependent is based on the ILR of the main applicant, as long as the main applicant qualifies for ILR and the dependent qualifies as the dependent of the main applicant, the dependent qualifies for ILR (as a dependent).
