help needed please

i intend to marry my fiance, i am british, can we still marry if he has less then 6 months left on his visa, or will he need to apply for extension, i am very confused with the immigration laws, thanks, p.s we do not live together but intend to obviously when we are married.

He can marry in the UK with less than six months on his visa but if he intends to switch his status after the marriage, his leave must not have expired before he makes the application.

thank you for your reply luca, do we need to contact immigration first or is that done via registery office, am quite clueless, what application does he put in for when we get married, or begin to live together to enable him to work full time to support us, as i have 3 children that are from a previous relationship, thanks again

You don't need to contact the UKBA. After the marriage he can switch from his current and legitimate immigration status (if he has and still is living within the terms of its issuance) using form FLR(M).

thanks, luca, just one more question if i may, does his particular visa matter i.e work visa, student visa does this matter when it comes to marriage

A person with anything other than a visit visa should be permitted to switch into settlement from inside the UK.

hey luca, hope your around tonight,

i have another small issue nigling me about my marriage to my fiance, as we are not living together at present would my current situation affect my marriage to him or any forms he will need to fill in after we are married, am asking as my situation is that im on benefits and ofcourse will not be on them when we live together, please just got a scare today so am worried

this is something important an immigration/benefit question, i just wanted to ask a question as i got scared today as someone told me my claiming of incapacity benefit would ruin my future marriage with my fiance with his flr ? when we are not even living together, ? i am british,, obviously when we marry or even decide to live together he works so will support the family, and i will come off, please this has scared me a little bit can it really ruin our chances of getting married ? sorry if i posted in wrong place but not sure how it all works yet

You simply need to show that you will be able to support yourselves financially without claiming additional benefits once you are married and living together. You are entitled to continue to claim incapacity benefit without it affecting your FLR(M) husband's application.

thanks for the reply, but now i am somewhat confused as after reading quite a few posts on here, i have come to notice that say for example when we do start to live together, and he only works say 20 hours per week, that me as the british citizen could claim something to top up with out it falling under the public funds sector for him, as i would think i am intitled to it depending on what he earns and the fact that i am british, please tell me if i am missing something, i know that cb i can claim in my own right for my 3 children but as a married couple or cohabiting couple we would need to claim jointly for wtc, ? and if my

a person with leave outside the rules-e.g. Discretionary leave can't switch either.

i just read on the ukba website, it states that form flr if he submits form flr on the grounds that we got married it asks to prove we have been living together ? but what if he has only moved in 2 weeks before we get married and he has to put in his aplicatation a month after, how much evidence can we prove in that short time of cohabiting, is it a must that dating couples have to live together before marriage, if one is subject to immigration control, ? and is it 500 the right fee for the form, thanks
