Eligible for Discretionary Leave under Article 8?? Help Plz

Post by shefmd » Fri Sep 30, 2011 3:57 pm

HI,

I came in UK in 2006 on a student visa. Plan to study Masters Computer Science but I could not complete this because I have health problems. My course basically was 1 year master's course but after starting the course I started to have mental health problems and University allowed me to stay on the course for 5 years to complete it. But now University finally told me to withdraw from the studies because i am not well enough to do it. Now I have serious mental health problems, have been admitted to hospital twice in last 3 months and still under mental health care and crisis team. My student Visa expires in Jan 2012. My family in my home country do not think that I have any mental health problems (even though my mother is schizzophrenic and my uncle committed suicide because of depression) they believe that I am just lazy and useless. I am really scared of going back home.I actually went back two years ago and withdraw from the university but had a very harsh response from my family towards my illness, then came back and rejoined the uni again. Now that I've been told by university that I am not fit to study, my mental health nurse advised me to apply for humanitarian or Discretionary Leave to remain in UK. I want some advice about it. Am I eligible for that on medical grounds?
