Tier 2 General refused

Post by nonconformistpagal » Fri Sep 16, 2011 7:01 pm

I had not submitted my original degree certificate. But submitted a photocopy. Therefore the visa was rejected.

But now i am applying again with the same cos number. Will it get rejected again. How do i ask my employer to chk if the cos has not been used?

How many times can we apply for this type of visa. Is thr a limit?

Thank you for the info.

170. Your Certificate of Sponsorship is valid for one application only. If your application is refused, you will need a new Certificate of Sponsorship before you can apply again
Is this for an application inside or outside the UK? If it's inside the UK, you should be able to appeal but, obviously, a new application may be quicker if you can organise a COS. The fact that the degree existed before the decision is relevant to an appeal. You would merely be showing evidence of this at the appeal.

I think Lucapooka may be wrong in the 170 case as the link has not been posted. I am applying again tomorrow. Shall let you know the status in 15 days.

Please suggest if I should not and if possible kindly post the link to the 170 point.

Here's a good tip. If an item of text from the rules or guidance is cited but not linked, you can easily hi-light the phrase and then right click>search google. If it's from an official source you will be directed to that webpage.

Here's another good tip. If someone cites a paragraph from the guidance and actually gives the paragraph number, you can simply look it up for yourself in the guidance.

And finally, if no information is cited but you have a vague idea of what you are looking for, you can search the guidance document by hitting ctrl>F and entering key words or phrases in the search field. All instances of that word or phrase will be indicated, saving you the bother to read through the whole thing.

Here is the Link for UKBA Immigration. I have read each and every point of it, at no point does it say, that CoS once applied and refused cannot be used again.

You are looking in the wrong section of the rules. Read Appendix A - Attributes. Paragraph 77C (e)

Do not apply with the same COS no. Your visa will be refused again.

Original CAS Letter

Post by nonconformistpagal » Fri Sep 30, 2011 4:03 pm

Visa got refused again...... :( ! Completely disappointed with this. Hopefully my employer provides me with another CoS.

In the refusal letter it has been written as 'The CAS letter provided is not original and was used in the previous application'. But I fail to understand if the CAS/CoS is applied through the Sponsorship Management System, how would we be able to get an Original CAS letter? Please guide. Thanks.

Of course!

CAS is for Tier 4 applications and is nothing to do with Tier 2. You should seek professional help as you clearly out of your depth with these issues.

Hi,

I am applying again with a new CoS number.

Is it necessary/mandatory to submit job postings as part of Resident Market Labor test, conducted by my employer?

Reading the policy guidance should help.

Yes I have read the guidance. I believe that it is not required to submit photocopy of the job posting in Job Central.

But, it is NECESSARY to provide the reference number for the jobs done in Job Central as well as through another medium. In my case it was a reference to fish4jobs.com.

This thread also helped me reach this conclusion: http://www.immigrationboards.com/viewto ... ht=refused

Please correct me if I am wrong.

Submitted my application at Bangalore India for the 3rd time, hoping against hope the application goes through smoothly at least this time :|

Finally my visa is approved. Such a relief.

Also, as I have previously mentioned, there is no need to submit job postings. Just a reference to Job Central and another post is enough for your Tier 2 Visa to go through.
