Post by bazdia » Mon Oct 10, 2011 12:18 am

Hi all,

My dad's 5 yr visa expires on 6th Dec 2011, He intends to travel from Abroad to UK . i would like to know how long before his visa expires should he make it into UK to apply for an extension . His Visa Status is " Resident Card of Family member of EEA National " .

Thanks,

Are you the EEA national? Have the EEA member been living in the UK for continuous period of 5 years? Have your father lived in the UK for a contentious period of 5 years?

The reason I'm asking is that under EEA regulations, you automatically obtain Permanent Residence in the UK if exercised treaty rights for 5 years.

With regards to your question, he should be allowed to enter the country as long as this "visa" is valid (even on the last day). As a matter of fact, he should be allowed in even after the expiry date if the EEA sponsor is still exercising treaty rights and he can prove it.
