failed asylum seeker

hi every one, iam new in this forum and iam afailed asylum seeker. i was refused on my first initial claim when i came to the uk 4years ago. in 2009 i made a fresh claim and it was refused in 2010. when all this happened i was single. now i have a family here in the UK, my partner has ILR and my 7month old daugher is a british citizen. now my question is can i make another fresh claim based on the Zambrano case.
i would appreaciate if any one could help me on this one

i' m an overstayer, i live with a british national as partners, we have a daughter together.
my application:
EEA 2 Form.
My ID (uk drivers licence)
Daughters Birth Certificate(to show im the father)
Cover letter (stating my claim on zambrano ruling, and also i went far as explaining why my removal from the uk will effectly make my daughter move from the uk)

i got a response from ukba liverpool saying that i should send my daughters passport to prove that she is british.
i'm quite excited that they are considering the ruling. Somebody made application based on this ruling you can also try it. Good luck

I'm not the actual applicant, i saw it one immigration forum and thought its similar to your situation, you can also give it a trial, you have nothing to loss the application is free and even if the application is refused you will have right of appeal which i'm quite sure court will allow your appeal based on Zambrano ECJ ruling.

i just received a phone call now from the UKBA and they said i should come and collect the decision of my application tomorrow. i will let you guys know once i collect it.

hi every one, just need to let you know that i have been granted Discretionary Leave to Remain. i submitted further submissions based on family life (ZH Tanzania best interests), Zambrano Judgement since i was a failed asylum seeker. submitted on 30/09/11 decision DLR granted on 06/10/11. i collected the decision today. now i can enjoy proper life with my family. i would like to thank everybody in this forum for their positive input god bless you.
