Post by mirzhar » Wed Oct 12, 2011 7:40 pm

i have EUfam 4 card exp in 2014

I am moving back to UK with my wife and son who are British . I saw a law that when u r married with British citizen more then 3 years then you can apply for ILR

What some one will recommend me that shall i apply from Ireland or shall i go with my Wife and apply there ? As my wife is not working at the moment

She had a job offer from UK

Any advice pls as it will be very valuable

If married for at least 4 years and living together outside the UK for 4 years preceding the application, then you may be eligible for ILE (281(a)(i)(b)).

ILR cannot be applied for from outside the UK.

1. ILE cannot be applied for from within UK.
2. ILR cannot be applied for from outside the UK.

If you enter UK under the EEA directives (using your stamp 4 EUFam), you'll be able to apply for leave to remain (FLR(M)) only and that too only if you are allowed to switch from leave under EU law to leave under UK immigration law (which I am not sure of).
