Re apply for EEA2 after a first recidence card

Hello everybody

I would laike to expose my case.
I am A french citizen, and in 2007, my husband was issued a 5 year residence card, by the EEA2 application form. I was working at that time.
After one year, we moved to France to settle, so we weren't working in the UK.
Now we want to re-settle in the UK. My husband has got his Residence card until 12/2012, but he can't apply for EEA4 as I wasn't working for the last 4 years.
Is it possible to apply a second time for EEA2 in december 2012, if I exerce treaty right in the UK by this date?
