Questions regarding Tier 2 Application

Post by williamson321 » Fri Oct 14, 2011 9:27 am

hello friends I hope you can help me. I am on PSW and company has received a license today and they are going to sponsor me for a COS.

I am have been working for the company for 11 months on 16500 per annum working as a hardware technician. My boss has agreed to give me a pay rise to fit into the salary bracket required by the code of practices.

I went through the code of practices and the role of hardware engineer and my employer has agreed to to raise my salary to 20,800 according to SOC code 2132 which has Hardware engineer. HR will generate a COS but has

Reading through this forum I have a queries

1. I will be payed 20,800 per annum,so how many hours should I enter as working hours ? since even an hour less I would fail the required salary as salary is exact 20,800.
2. Is the SOC code for graduate Hardware Engineer 2132 correct ? http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary
3. When to give start date of COS ? ( I will be payed 20,800 on 20th of this month and onwards. and visa expiring on 31 November)
4. Do I need a covering letter from employer along with payslips ?
5. I am not on 16,500 in last 11 months and only will be 20,800 from this month. I hope thats not a problem ?

thank you in advance.

1. Well i had this same dilemma as i put down 40 hours per week instead of 37.5 but i still got it. My job was on Section - J, I know someone had put down 40 hours but they're required to show "Hourly rates" so they failed. So i suggest you read the guidelines carefully to see whether your job falls under a annual income or a hours rate as required by UKBA. But 37.5 is the standard hours.
2. I can't confirm this but first you have to check which job description matches your job most then pick a job title then look for the requried salary for that job title. This is the procudure. Check with a solicitor to double check.
3. My PSW expired on 8th Sep 2011 and my HR put down my start date as 7th September 2011 (A day before my PSW expired as advised by UKBA) So check with UKBA !!!
4. No you don't. But make sure your payslips are in correct format as required by guidelines (Like if you print them on a paper you have to get your employer certify them etc) I submitted my original payslips and didn't submit any letter from my employer.
5. As long as you're getting paid the required salary according to COS from the date you apply you're fine. Remember the last 6 months payslips are to prove you're working for the company for 6 months not to check how much you're earning. Your employer must put down the correct salary in the COS when they assign it to you.

Remember don't apply 3 months before the start date of your COS. I know someone in this forum got rejected because of that.

Any questions post, ill try my best to help.. :)

I am not payed hourly its annual.

So am I to put 37.5 or 40 hours in CoS ?

2. The code 2132 for Hardware engineer is the closest match to my job description so employer has going to pay be exact to salary mentioned for that role 20,800.

All the questions have been answered but still don't know how many hours to put as my salary is exact as required by UKBA. One hour less and I will fail and be rejected.

How many hours per week you're working ? You don't want to put down too many hours. Why don't you calculate the salary and see if it matches with the required level ? if it does then you're fine.

-williamson321 - I think if you think that if particular SOC code is the closest match to your responsibilities & job description then it should be fine. 2132 for hardware engineer looks OK from the document you attached.

The number of working hours has put me into doubt too as I will be generating a new CoS in the next few days. My salary is also the exact match as required by my SOC code. I am not an hourly paid employee.

You should be fine as long as your job meets the SOC salary level, I had the same problem as my HR put down 40 hrs. But It went through smoothly. make sure to put 40 hrs in your application form :D Good luck mate.
