certiCERTIFICATE OF APPLICATION(breaching right of movement)

Post by Kaye » Sat Oct 15, 2011 5:17 pm

Hello All,
I decided to join this forum because I will like to launch a campaign against the UKBA agent of home office about withholding of passport of eea and non eea family member.
I will like to see it tested in court , why non eea family member with certificate of application , they cannot travel outside the country because of fear of re- admission because they must obtain eea family permit( I believe this is a measure) every time they are out of the country which i think is infringing the right of free movement for the eea national with their family, furthermore we will like to test if this can hold under the human right act.
Please everyone contributing to this forum we may take up a legal challenge and will be well appreciated , I will be looking for a barrister and post it on this forum soon. watch out!!!

HI KAYE, I AM WITH YOU ON THIS ONE AS I AM HAVING A NIGHTMARE WITH THESE IMMIGRATION PEOPLE AND THE RATHER OFFENSIVE AND RUTHLESS ATTITUDE IN TRETING THE EEA AND THEIR FAMILLY MEMBERS, I THINK I WILL GO AS FAR AS PUTING IT DOWN TO RACISME AND NOT OBEYING AND DISREGARDING THE EEA LAW, THE ATTITUDE IS MISLEADING AND DESTROYING OUR FAMILLIES. THERE YOU GO. I AM IRISH MY WIFE IS NON EEA, OUR 2 KIDS ARE BRITISH CITIZENS AND SHE HAS JUST APPLIED UNDER EEA4 APPLICATION FOR ILR AND THEY HOLD HER PASSPORT AND TOLD HER ON THE LETTER TO GET READY FOR VOLUNTARY DEPORTAION BASICALLY, WHAT THE HELL IS GOING ON WITH THESE PEOPLE.

yes, one response and counting, we have to do something even if the civil servants is being put under pressure by the ministers, who cares? they have to behave proportionately and not draconian style of abuse. Eventually the ECJ will have to rise up to this or the UK can leave the EU altogether if they want and that will pose a lot of problem for them which I guess the reasonable ones in power amongst them will never want to go for that option.

ithink the way to tackle this current problem is to put it to them firm once we will be few hundred or even thousands, we will have to notify them of this then if they will be rejecting it i suggest we go the the court of justice ECJ, AS SIMPLE AS THAT

LET S WAIT FOR A WHILE FOR THE RESPONSE THEN LETS ROCK AND ROLL.
