What happen to Tier 1 dependent visa?

Post by xpscapable » Fri Oct 28, 2011 1:20 pm

Hi,

Quick question, what happen to Tier 1 Dependent visa when the main person (Tier 1 person) got his/her ILR. Does that automatically void the Tier 1 dependent visa? Does that mean the dependent must change to ILR dependent or other type of visa?

Thanks!

No.

Assuming the dependant to be a spouse / partner:

If the dependant is not eligible for settlement at the same time as the principal migrant, the dependant should switch to FLR(M) leave before his / her current leave expires or he / she travels outside the Common Travel Area and definitely before expiry of current leave. The dependant may then be eligible for settlement (SET(M)) as and when 287(a)(i) is met.
Life isn't fair, but you can be!

Thanks, just clarification:

So I can apply for ILR while my wife still in her Tier 1 Dependent until that visa expires?

I can apply for ILR July 2012 while my wife Tier 1 Dependent expires in May 2013. So can she stay on that visa? Because by that time she should qualify as my ILR dependent (2 year co-habitation rule).
