Tier 1 refusal

Post by gokuden » Sun Oct 30, 2011 6:04 pm

Hello and thanks in advance for reading my topic.

I was doing a master degree last year and graduated on december and I applied for the Tier 1 post study work visa. I held the money for 90 consecutive days as requested but in the last day, the bank took some money as an administrative charge and the balance went below the required amount. I applied like that and attached a letter explaining that it was the bank and it was just 1 pound in the last day. However, they refused my application and told me to make a fresh application. They just sent a letter stating the reason of the outcome and my rights to appeal. The letter has also a section "Removal from the UK" where states that in case I did not want to appeal, I had no longer the right to stay and I "should" leave as soon as possible. That was all...
I did not receive any other letter like a deportation note, IS151a or APP104.
And I just leave 3 days after, when I managed to moved my ticket back.

Now, I want to make a fresh application from my home country and during my online application, I come across with two questions, one is "if I ever been refused a visa for the UK" and I answered "YES" and gave the details. But there is another question that concerns me and I cannot get help from the local british embassy. The question is "Have you ever been deported, removed or otherwise, required to leave the uk?". What should I answer? if the options to be selected if I select "yes" are (deporte, IS151A and APP104) but I did not received any note, I just received the refusal notice, rights to appeal and a note that I should leave if I was not going to appal but I left inmediately.

Should I select "NO"?

That's a mistake. You should answer no. Visas are (exclusively) entry clearance documents that are applied for and emitted outside the UK. Applications made inside the UK are referred to as leave to remain and result in residence permits rather than visas. So clearly you have not been refused a visa application. There is another question that comes later in the VAF9 that asks: Have you made an application to the Home Office to remain in the UK in the last 10 years? This is where you should refer to your refusal of leave to remain and explain the circumstancers.

Answer no.
