Regarding Child Benefits

Hi,

I hold ILR for last one year , My son joined me in UK reently from India who is ILR dependent on me, He is 2 years now. He and my wife both are ILR dependents, Can I apply Child benefits for my son.Please help me

You have ILR and are therefore perfectly entitled to claim any benefits that your circumstances dictate you are entitled to. That will include Child Benefit, and also Tax Credits, unless the family income is nicely over £40000 pa.

You use the term "ILR dependent". I do not recognise that. Does your child have a visa endorsed "Indefinite Leave to Enter"?

Thanks for your quick response. When i applied ILR that time my wife and son was not in UK. So they got ILR dependant Visa to enter UK. I recently claimed a Child benefit ,don't know whether i am eligible to get that. And also i didn't send my P60 , How will they get to know my salary.

A few points. Firstly Child Benefit is not means-tested, well not until 2013, so your salary is irrelevant about whether you get Child Benefit.

Secondly, you continue to use the term "ILR dependant Visa". What do you mean? As regards your wife, I would assume she has got a 27-month spouse visa. Correct?

But as regards your child, and assume the child is yours biologically, and not a step-child, that child should have an Indefinite Leave to Enter visa. Correct? Or has the child also got a 27-month visa?

Thirdly, a possible claim Tax Credits? Unless the family income is nicely over £40000 pa, you and you wife should jointly claim Tax Credits.

Both my wife and son got 27 months visa.For ILE they told us both the parents should hold ILR.as my wife is not on ILR my son also received 27 months dependent visa.Is he eligible now?

The visa can be corrected in the UK.
