6th APRILL 2011 5 YEAR RE ENTRY BAN REDUCED TO 2 YEARS

There has been a change in the rules from 6th april 2011 according to which if an applicant was banned for 5 years (320 7b) and he leaves uk voluntarily within 28 days the ban will be reduced to 2 years ...was that just a proposal or is it effective from 6th april 2011 and does it applies to some one who was banned back in 2008 ..need help i am in trouble big time

It is applied retroactively to bans for breaches that occurred before the rule changes (obviously as it refers to circumstances that happened 2 years ago!) but needs to match the circumstances described in the rules.

left the UK voluntarily, at the expense (directly or indirectly) of the Secretary of State, more than 2 years ago; and the date the person left the UK was no more than 6 months after the date on which the person was given notice of the removal decision, or no more than 6 months after the date on which the person no longer had a pending appeal; whichever is the later;
