Uk citizen with children query

Post by Lana83 » Thu Nov 03, 2011 8:51 pm

Hi,

Im a Uk British born citizen. I have children from a previous marriage for whom I receive child benefit and child tax credits. I dont receive HB because as a mature student I receive too much in loans, grants and bursary's.
If I married my Non-EU partner, how would I stand in relation to these benefits? Would I still be able to claim them or are we both subject to 'no access to public funds'?
As a side note, because I'm studying and living on loans, grants and bursary's would that effect the maintenance part of the application? (He is on a student visa).
Thank you in advance

You are British and perfectly entitled to claim those benefits. But as regards Tax Credits, such a claim will need to be in joint names, from as soon as the two of you start to live together. Indeed are the two of you already living together? And if so, is the Tax Credits claim already in joint names?
As a side note, because I'm studying and living on loans, grants and bursary's would that effect the maintenance part of the application? (He is on a student visa).
Clearly an important part of your post, so I am not going to just ignore it, but personally I have not got a clue about that. Hopefully someone else has.
