does anyone have the link for it?

i am interested in knowing , basically, under which para can the caseworker refuse the visa when;

there is not a 100% match between employer's choice of job description & job title(as recorded on sponsorship management system) and what's written on code of practice.

i mean, is it even possible to get refusal based on that. UKBA guidance puts the onus on employer to choose job title etc from code of practice so it kinda suggest that they can't over rule what employer has suggested already.

please advise

am i right to assume, they can't?

also, there is no foul play involved here. my Actual Job description meets like 80% of what's stated in Code of Practice. i am just feeling a bit nervous that UKBA might refuse the app saying something like...

"you should have applied under SOC code xyz instead of SOC code abc, as that is more appropriate to me"

OR

"your currently chosen SOC code doesn't totally agree with your job description"


Can someone tell me how realistic my fear of getting refusal is....

Hi Arsenal

Haven't read anything where the UKBA has overruled employer's chosen job title, so not sure.
But it is true that it is the employer's onus to provide the job title. Don't worry about it. If you have already made an application, just sit back and relax :) No point in stressing over it :)

Sometimes the job title cannot possibly tie in exactly with the SOC because the SOC is not 100% exhaustively complete. You have to use the closest code. If you do so I can't see a refusal being reasonable on those grounds.

A question on a similar lines. What if a job is listed with a different SOC in the Office for National Statistics - SOC 2000 and different SOC in UKBA code of practices.

Which code would the case worker take into account ?
