Pre action protocol

Oh no not so good with ya case sorry to hear that, Whats your history concerning ART8.but when ya solicitor lodges the PAP they might give you a reconsideration depending on how strong ya ART8 is, and the length of time you've been in Uk so fingers crossed. As of my case after the PAP letter the HO had said to give me a reply by the 4TH Aug which they didn't, so i asked my solicitors to write to the TSOLS but they kept messing me about since then so i sacked them gat new ones but they haven't transferred my file, so will get the ball rolling again by writing to TSOL, if no deal comes up then JR.

I applied under Art8 based on my children education..right to a private life. Been here since 2001 and they refused based on the ground that the children can still enjoy education back home. However both of my children have a brief education history back home. My son spend all his primary school in UK and my daughter never had an education back home. So stress ..

What kind of visa have you been holding from your time of entry,how old are the kids, have you got any other family ties, any compassionate grounds, which country you from.

Hi Joejo

Student visa, work permit and student visa again. The work permit become invalid due to the company closed down..son 18 yrs..going to uni next year., daughter 13yrs on year 8..got uncle here in UK , he is British citizen..i do have compassionate grounds but my son do..he is in relationship with British girl.I'm from Malaysia.

So i assume you gat a gap in your 10yrs law full residential as in your WP being invalid, thou a few people have applied through 10yrs with gaps and have managed to succeed with evidence and reasons of the Gaps.However your son may be classed as an adult being 18 now being able to relocate and adapt else where but on the other hand DL would be in ya favor as the kids have settled from a tender age in education, Family ties as well, your uncle a citizen, then your sons gal but you need evidence like fotos, mails, letters etc to support your ART8,with a good solicitor you gat a ground. Does HO know of your ties uncle,sons gal?

When I apply for for DL must son still 17 he just turn 18 last month, HO does not know that i have uncle here, did not mention to HO before..
I have lots of photos. Plus I'm still have one exam to complete and will be doing my PhD soon.

I know with good solicitor i will get thru this, but it just stress. How is yours case going on.
