Judicial review - ILR (long residence) refused due to gap

Hi Guys,
HO refused my ILR, because I had more than 10 days gap in my one visa extension in last 10 years.

2 years ago my Solicitor forgot to put the bank details for my wife fee section of (£50) and my applicaiton was returned as INVALID and then we submitted again. I had more than £3000 in my account in this whole period when they returned my application as invalid.

Now I applied to Judicial Review pre action protocol, Please advice what kind of response do we get from the HO Judicial Review Dept.
