can I marry my boyfriend if his passport is in the home offi

Hi, I am an european citizen and my boyfriend has his passport in the home office because he is doing an appeal for a visa, could I marry him?, it would help?....

Don't think so, as he would have to have three months left on his visa to apply for CoA, and as his visa seems to be under appeal, sounds like it's expired or expiring....

Actually the Home Office have withdrawn the 3-month bit. It is merely necessary for the person to have a valid visa.

Old visa expired? Maybe not. Can we be told please what sort of visa he is applying for, and whether the new visa was applied for before the stated expiry date of the old visa?

thanks for quick answer.His student visa expired few months ago,days before expired, he aplied for WP but his company doesn´t sponshor him, he was starting a business with his friend before this,and then, he aplied for innovator.

He aplied for innovator days before expiring the old visa.....

That being the case his old visa is "treated as continuing". He is not an overstayer.

Accordingly it might be worthwhile him applying for the needed Certificate of Approval to Marry. But do accept that we are in uncharted waters here, the Home Office only recently relaxing the CoA rules, having been forced to do so by a couple of Court Judgements. It is best you read this.

Also read this and appreciate that there is the need to comply with that, when submitting the needed CoA Application Form.

We are thinking to appeal again, this nex time with our marriage certificate(we were preparing this but now we have to accelerate the wedding because of this), as well we were trying to buy a house and rent the rooms to pay the mortgage, cos I have a house in Spain as a garantee, we were thinking also to fostering a child in this house, he is social worker, and this idea has been in my mind for a long time, and he agreed, plus he is studying an IT course as PC maintenance and repair in his college on saturdays, he paid this course till June, we were looking for all this information when the letter arrived.

My question is "All this things would help him in the next appeal?

Sorry for the long e-mail, but we are frustated, it looks a business for them, they are playing with real people lives and hopes... don't they understand?.I am trying to have a baby with him, I am 36 already and he is 34, but, how can we with this unsecured life and all the money he is spending in this immigration issues?...
