came to uk on 2004 as a student and got married in channel island in 2006, i have passed my citizenship test on 2009 applying for ILR on 2011, my wife wrote to immigration after 2weeks i submitted my application, telling them that our marriage is breaking down and she dont want to support my application and now they refusing to give me my ILR, what can i do pls and we been married for 5years!!!! any advice as they refusing to issue me ILR in the channel island (guernsey)and am thinking of reapplying in London

If your sponsor has informed UKBA about breakdown in your relationship and has refused to sponsor your application for settlement then you are no longer eligible for settlement as spouse of settled person / British citizen.

Is there hope for reconciliation? Will your spouse be ready to support an application for extension instead ... and see if the relationship can work?

Do you have any children?

No kids involved, She want to divorce but i dnt want to but can she extend my application as they have already stamp 3month on my passport? is there any option for me to apply for something different rather than ILR? please ur advise is needed urgently thanks

Your permission to enter and remain in the UK is on the basis of your relationship with a British citizen / settled person and the said person sponsoring your immigration application.

If the person does not agree to sponsor your application for either extension (FLR(M)) or settlement (SET(M)) because of any reason(s), then the only option for you is to apply under an immigration category that you may qualify under - but any such application will have to be made from outside the UK.

Given what you have posted, it doesn't seem that your circumstances justify UKBA granting you discretionary leave to remain in the UK.

Thank you very much for getting back to me, Now which category do u think am qualify under? because i have no clue on how the immigration rules works.remember on my previous msg i told you that i came to uk 2004 under student visa and got married 2006 in guernsey channel island uk so which category did i fall under as i got no time and need to think fast before is too late, thanks!!!!1

Only you can determine which immigration category you qualify for .. forum members cannot.
UBA website lists all the immigration categories currently available.

This seems like a complicating case. Is there a chance of your marriage being reconciled? What are you doing at present? are you studying?

At the moment i dont think so but am trying my best to work on it, am working at the moment, do u know of any category am eligble to apply for as i have not gt clues on hw the system work, and am running out of time as well any gud advice will be helpful thanks

if you have to leave UK to apply for "entry clearance" AND will not be in possession of visa (at the time of leaving UK) which would let you back in UK later on.... your ILR clock will be reset!

Sounds like Tier 4 student visa is your best bet. failing that, you need to find an employer who is willling to sponsor you under tier 2.

But yours is a bit complicated case so tread cautiously and try to reconcile! that would solve everything, well immigration wise at least....

try to get some help from local "citizens advice bureau" clinic too

Thanks for your reply just want to know since am working as a security guard(doorman) can i ask my employer to help with my application for work permit? your advice is needed pls!!!!!! life is not fair

your job must be listed in 'Code of Practice" Tier 2.

See tier 2 requirements on UKBA pages.

It also requires you to have a graduate-level job which i suspect is not what you are doing currently so you might not satisfy tier 2 criteria.

work permits are obsoelete. Tier 2 visa is the present-day equivalent thing.

PS. find another EU/UK citizen if you can because i personally dont see how you can satisfy any tier based requirements , perhaps tier 4 student visa is the best remaining option.

I have gotten a certificate in business diploma and have work in 2 different bank here, why am doing the security is because is hard at the moment to get a job in finance. so the only option i have is Tier 4, so applying for tier 2 now with the current job am doing now is out of the window? pls help

Thanks asernal 49 for your contribution, like they say if you dont asked u wont know. Am wondering why they gave me 3month to sort my personal affair?which is expiry 31/01/2012 is that right? cos is a short notice, i havent gt enough time to sort any of my personal affair while i think people that have similiar problems like me are given one year? any advice will be helpful
