ILR advise please

Hi All,

I am hopping to get some advise on my case.

I am a work permit holder (old closed category) and close to my completion of 5th year. My dates are as follow:

13/02/2007 > got stamp for work permit
17/03/2007 > Entered the UK 1st time (32 days gap in my first entry to the UK from stamp date on work permit)
13/02/2012 > current permit expires

The following are the dates of absences:

10/11/2007 left the UK > 20/11/2007 returned to the UK (10 days)
16/02/2008 left the UK > 17/03/2008 returned to the UK (30 days)
31/10/2009 left the UK > 30/11/2009 returned to the UK (31 days)

My questions are as follow:

1. When earliest I can apply for ILR considering 28 days rule i.e. which date? Will I be eligible for ILR considering I delayed my 1st entry by 32 days? I am thinking to apply on 16/01/2012 by post (28 days before expiry of current visa)
2. Will my 1st delayed entry (32 days) to the UK be considered towards total absences? If yes I will be in total out of country by 108 days. Is that a problem?
3. If my visa expires while they are reviewing my file, will I be on legal status to continue until decision is made?
4. If ILR is refused and the current visa status expires, can we appeal from within the UK

Any advise will be greatly appreciated.
