Making fresh application while appeal is pending

Hi All,
My wife's dependent visa was rejected. I am in process of making appeal against rejection.

Is it possible that I can make fresh application in case appeal takes long time?

You say "visa", so I am assuming that this was a "entry clearance application from outside UK.

In such case, see APL1.20 Applicant makes fresh application while an appeal is outstanding

Yes, I am on Tier1 (General) visa in UK. And my wife had applied for dependent visa from India.

So I believe this rule applies to me. Is it correct?
