Quick Overstay question

Hi, just another overstay question.

My student visa expires on 30th of this month. I finished my 2 years HND course from a college. I enrolled for my course in September 2009, which means my course should end on September 2011, but instead my college finished the course at the end of July.

Now, according to UKBA's site I can stay for 4 more months after my course is over. So I wanted to know 4 months counting since July or 4 months counting since Septmeber? Cause technically it was a 2 years course, but like colleges and universities here, my college finished the course early.

Also after my visa expires, how long can I overstay, assuming UKBA counting 4 months since July?

If you believe that your visa was issued with the wrong duration of leave (i.e. - not in accordance with the rules / policy at the date of such application), then you must get the error corrected.

Don't assume that even if your visa expires on 30-Nov you'll be able to (legally) remain in the UK just because of what the UKBA website /policy guidance state.

If you remain in UK for more than 28 days from the date of expiry of current leave, it will affect any future entry clearance application(s).

So if I leave within 28days after my visa expires, I will be ok? Like I will not get a ban or pay some kind of fine?

But, if you do remain in UK beyond the date of expiry, do not forget to mention that fact if any immigration application form asks for such information (even if you leave within the 28 days window).

That said, ihaving read you posts in another topic I am wondering - Is ILR under (10 year) long residence a potential aim? If so, then you must leave before 30-Nov.

Will do, thanks. And yeh I do intend to leave after my visa expires but within in 28days window, will depend on the plane tickets.

Well it was actually, my intention was to apply for DLR and then IRL, but after reading those posts in that topic, I decided to not to go with it.

I will strongly recommend you to leave before 30 November, if you want to come back in future. Although there is 28 days grace period mentioned in law but overall, Overstay is bad for your immigration history.
