eea2 refusal won but still awaiting passport for 3 months

eea2 application was refused in july, but we appealed and won the appeal on the 30th of august 2011. we did not hear anything from HO until the 20th of october requsting for a letter from my spouse's employer (almost 2 months after appeal allowed). this was sent the following day. now over 4 weeks gone after that and still awaiting the passport or a response from HO. My solicitor said we still have to keep waiting. It has been almost 12 weeks since the appeal was allowed..... dont know if to keep waiting or start chasing it up my self and leave my solicitor out of it.

Has anyone been in this situation.... please advice on what to do. thanks alot
