EEA2 Application

Hi,
I am on student visa. my visa will get expire by Feb 2012 end. If I apply this month end and then go back to India with my spouse who is an Irish national for 15 days and come back here before my visa ends. Is it possible to get my passport back once I apply for EEA2? And if yes then with in how many days I will get my passport back?

When do you plan to travel?

You can ask the HO to send your passport back as soon as they receive the application and examine it. Realistically, you are talking about 3-4 weeks (without taking the holidays into considerations).

Better to apply after you return. If you are married to a EEA national exercising treaty rights in the UK, you have the right to reside in the UK. Having or not having a Residence Card doesn't change your legal right to live in the UK. Even if your existing student visa expire, you are legal.

In any case, it would be wise to carry your marriage certificate with you and some payslips of your EEA wife. When returning, either enter on your about to expire visa or produce the documents and enter as a family member of EEA national.

We are planning to go India on 15th of January 2012 and we will back by 15th of February 2012. My student visa will get expired on 28th of February 2012.
Thank you so much for this important information. We will carry our marriage certificate, tenancy agreement, her bank statement, her college (she is graduate from UK).
