5 months break while waiting for visa

Post by mariamuk » Wed Nov 30, 2011 1:43 pm

Hello,

I would like to ask a question on behalf of my very good friend.
She has been in the UK for 10 years and now found out that she had a 5 months gap while waiting for her other visa (postal application).

I presume this should not be an issue since she never left the UK but was awaiting for the decision from the Home office in London.

Can anyone confirm this or let me know if this can be a problem and how to avoid it.

Thank you in advance
Mariam

If a valid, in-time application was made and the leave (valid at the time of application) expired while waiting for a decision, then there is no gap (section 3C).

Hi
Sorry to escalate it again

Does she need to prove anything, it was years ago and she does not have a postal receipt any more or it is all logged on the UKBA database?

Thank you
