Many thanks for looking into this thread.

My brother is enrolled in Jan-2011 MSC course which will finish on 31-Jan-2012. Now today he asked from University that when he will get result cards then he was told that in May-2012.

Now We are concerned that he can't apply for PSW, as it is going away from april-2012.

So question is what he needs to produce home office for applying PSW?

I appreciate your response please.

The policy guidance explains the documents required to prove evidence of qualification when the degree has not (yet) been awarded at the time of application.

in fact the guidance explains the documents required when the degree has been awarded but the certificate has not been issued. It is not possible to apply for psw before the degree has been awarded. The op's brother needs to ask his university if the exam board can sit earlier as may 2012 will be too late.

First thing first, from which college or uni he is doing the masters ... I really doubt it wont be finish in 12 months it usually take 14 months to more.

secondly, ask your brother to gather more NON EU students and speak to management and let them know the real issue. they might sort this out.

Unfortunately degree, transcript and college letter are must to apply for PSW

there are cases where people did apply and got the approval but majorly UKBA refuse the visa.

Yes, if you already have your results. The UK Border Agency website does not make this clear in all its information, but see Original Letter from United Kingdom Institution under the heading Extra Information for confirmation of this. See also paragraph 62 of the Tier 1 (Post-Study Work) policy guidance for details.

What is not clear exactly? You can apply for PSW once you have been awarded your degree but before you have your degree certificate. If the certificate is not available the letter from your insitution needs to state this. You cannnot apply for PSW before the degree is awarded.

Hi Khurram

Before providing any input, the first advice I'd give you is to take a step back and relax. The majority of mistakes happen when you either rush or get too hyped about the situation.

As far as your question is concerned, it is quite simple :

1. You can apply for PSW as long as you have been "awarded" the degree.

2. If you don't have your degree certificate then you need a letter from the university as per the following policy guidance -

an original letter from the institution at
which the applicant studied towards his/her
eligible qualification. The letter must be an
original letter (not a copy), on the official
letter-headed paper of the United Kingdom
institution at which the applicant studied. It
must have been issued by an authorised
official and must confirm the:
• applicant’s name;
• title of the qualification;
• Date of the award (as defined in
paragraph 79 of these guidance notes);
• the body awarding the qualification;
• explain the reason why the applicant is
unable to provide their original certificate
of award; and
• confirm that the certificate will be issued.



So all you need to do is find out from the university when will the degree be "awarded" i.e. the result date and how soon can you get this letter issued. I'm sure all universities are aware of the PSW regulations and will be willing to help you out. Hope this clarifies it, best of luck :)
