I was previously on tier1 visa and have just received my ILR . I've not applied for ILR for my 3 years old daughter who is born in UK as I am planning to apply for her British passport. We've got Indian passports and my daughter's passport still has Tier 1 dependent visa until 2013.

Since, we've got travel plans to go to India and don't have much time left to apply for daughter's British passport.

My question is, can my daughter travel with her Indian passport, will she be allowed to come back to UK?

I would advise against travelling as I think your childrens dependent visa might be invalid after you moved to ILR. They will allow you to fly to India but can stop the children from entering back if that is the case.

Do Check with UKBA before flying if you have to go to India.

Just to update - we travelled to India on Dec 2011 and as expected there was no issue at all. I was really concerned about our return journey. While returning in Jan 2012, no issue at Delhi airport immigration, but at Heathrow airport, the immigration officer asked why we don’t have settlement visa for my daughter and he checked that she is still on old visa (tier-1 dependent visa). I explained to him that we are not required to apply for her settlement visa as she is born here and therefore we can apply for BC directly. He was ok with that. I felt relieved however I am planning to get BC for my daughter before next travel.
