Tier 2 dependent appointment

Post by david1955 » Mon Dec 12, 2011 11:36 pm

Hi , I hope someone can help me with this...I recently submitted an online application form for tier 2 general dependent visa for my wife on 10 december 2011 and my wife biometric appointment is on 5 jan 2012 and thats when she will be submitting all the documents along with the application form. We are planning to do court marriage on 3 january 2012.
now as u can see my online application date is 10 december 2011 and my ccourt marriage is on 3 jan 2012 , which is after my application date.

Will this date difference proves that the marriage is not genuine?

On what basis is your to-be-spouse applying for leave if you two are not yet married? Have you been living together for at least 2 years preceding the application?

No we are not living together. We have just completed the online applicattion form with a appointment schedule to be on 5 jan 2012, and thats when we have to submit the application and all the supporting documents. So by the time we will submit the online printed application on 5 jan 2012 , we will be married. But not now. But the reason why i was curious is coz we have filled the online application and printed it. But the application date on it comes is the day when i have submitted it online. and not the appointment date as scheduled...so will they termed the application as invalid coz we are getting married after the online submission or will it still be valid as we will be submitting all the documents on 5 jan after marriage on 2nd.

On what date did you (or will you) pay for the application? That date will be the "date of application" and whether the applicant is your "wife" or "wife-to-be". If the latter, the application will be refused.

Should be okay then.

I would suggest that you draft a covering letter to explain why the application process was initiated before getting married - else the ECO may imagine / suspect something fishy about the arrangement and may refuse the application for some reason(s) e.g. - marriage of convenience.

Just another question, is there any rule like you cant submit your application before 3 months of your date of travelling or entry clearance date you are seeking?

No such requirement.

But, leave will be issued from the date the decision is made on the application ... and not according to the intended date of travel.

Hi Sushdmehta,
thanks for your valuable advice till now. In the above scenario, do you recommend me submiitting proofs like call logs and chat history along with the marriage certificate , to prove that we were in constact touch , hence proves the marriage is jenuine;.
regards
