baby visa

Post by Sana Abdullah » Tue Dec 13, 2011 4:06 pm

hi there
my husband is on student visa since 2001 and he is applying for indefinite leave to remain this month and my baby is due in Jan 2012, so i wanted to know whether we'll be requiring any visa for our baby to stay with us here in UK plus as i'm on depandant visa my visa will be expiring in May 2012.

so if there is no reply from UKBA for my husband's application till that time do i have to leave for Pakistan or i can stay here legally with my baby.

please guide me with the procedures as i really dont want to be among the illegal people who stay here and give rise to the more severe problems for future

Regards
Sana

1. When will your husband become eligible to apply for settlement under long residence? If he is already eligible, when does he intend to apply?
2. Will the child be born in UK or abroad?

1. A UK-born child does not require leave to stay in the UK. He will need one to re-enter UK if he travels abroad.
2. You will need to apply for FLR(M) before your current leave expires. If your husband's settlement application has not been decided by the time your current leave expires, apply for FLR(M) with a covering letter to explain that the principal migrant (husband) has applied for settlement and provide necessary details of the principal migrant's settlement application (name, date of birth, passport number, nationality, settlement application reference number etc.).
3. After your husband has been granted settlement, your child will be entitled to be registered as a British citizen under section 1(3) of the nationality act.
