Conviction and spouse visa

Post by ukcitizen1 » Sat Dec 17, 2011 12:21 am

Hi All,

I am a brit and until meeting my partner, held strong views about immigration. He was from one of the G7 countries...he has since become legal through the joining of the EU. Anyway, to cut many years short...he was and is friends with a russian. The Russian is a wonderful guy, kind, sweet was working hard for years and married twice. The first marriage led to his ILR. He has been here for years now and is trying to bring over his 2nd wife/child here.

Well, this kind, hard-working friend of my partner's has rather shockingly been arrested for credit card fraud. Yep, I am totally torn between, liking him and thinking he got his just-desserts...if it's true and it goes ahead. If it does, then just goes to prove that a criminal is not necessarily a nasty, horrible person that is into loads of dodgy stuff...they can also be your mate, that it wasn't quite clear what he was up to for the last little while...

I care enough to ask, please, I don't want lecture, just some help. What he has done is wrong, there is no disputing that and he will do the time, if convicted, but, I am worried for him. He has helped me before (not financially btw) and I want to try and help him - he is, afterall, still my friend...therefore:
1) Can the UK revoke his licence if convicted and if so, under what conditions? ie over 12 month sentence?
2) Will this null-and-void his application for his wife?
3) Does anyone have the contact details for a good/reasonably-priced criminal lawyer in london?
4) Can he be deported?

Thanks in advance,
Worried Friend
