Post by rafasreds » Sat Dec 17, 2011 12:48 pm

Im an australian citizen, came to the uk to watch football in 2002,ended up meeting

a girl who is now my wife.Ive overstayed all this time because ive had a job to support myself and also the fear of going home and not allowed back in the uk has made it hard to go back to australia and try and come back legally.Im now ready to go back and apply for a visa.i know im looking at a ban,im married to a british citizen and i have a british grandparent,i can pay for my flight home,im asking if anybody has been in similar situation or any advice
would b greatly appreciated.......stressed out big time

Your principal concern would be a refusal under 320 (11). For a settlement application they can't refuse you for overstaying but anything that you have done to aggravate that will be considered. You should take private professional advice on your situation (revealing everything about your history) to see if it's appropriate to apply for EC or to attempt an in-country application for DL; nine years is a long time and it's very likely that there is something on the 320 (11) list that can be attributed to you.
