Tier 2 dependant (extension of stay)

Hi,

I'm currently on a Tier 1 PSW visa and my wife has a Tier 1 dependant visa. I have been working with the same employer for more than 6 months. As such, I can score the maintenance points for the Tier 2 (General) visa automatically without the need to provide evidence of funds for myself.

My wife will be applying with me for an extension of stay as the dependant of a person who has leave to remain under the points based system. The policy guidance states that only when the main applicant is required to meet the maintenance requirements (and hence provide evidence of funds) is the dependant required to provide evidence of funds. Since, in my case, I do not need to provide evidence of funds, does it mean that my wife too doesn't need to provide evidence of funds?

I'm confused because, in the dependant's application form, if the main applicant is switching (i.e. initial application), then the dependant needs to fill in section K, i.e. show evidence for maintenance.

Any help will be appreciated.

Hi,

There are two ways in which your dependent should show funds.

1.) £533 per dependent for 90 consecutive days. (Show bank statement as a proof)

OR

2.) If your sponsor is A-Rated they can certify your dependent's maintenance. To do this, they will need to check the box that they are cetrtifying the dependent's maintenance in the COS and also issue your dependent with a letter doing the same.

I'm aware of the two ways to show evidence of funds. However, my question is whether the dependant in this case needs to show evidence of funds in the first place.

Hi Pal,

You automatically get points for funds maintenance as your are switching from PSW and have worked for your employer for more than 6 months.

This is not the same with your dependent. Hence you dependent will need to show proof of funds. When your spouse fills the application for PBS dependent please look at the application form on K2 and this will ask you to fill either one of the type of mainteance. Hence, the dependents have to show proof of maintenance irrespective of the main applicant showing proof of funds for his/her application.
