Dear all,

First of all, could you tell me what is the definition of "new graduate" in the SOC code? 1 year after graduation? 2 years? I could not find any definition on UKBA website.

Secondly, my company is paying me £22000 for a 35 hours week for a graduate job. The requirement for this job is £23000 for new graduate based on 37.5 hrs week or £14.52 per hour for others. As you can see the current salary is above the appropriate rate for new graduate but not the £14.52 per hour, so my question is how do you define "new graduate".

Thirdly, if the £22000 is the gross salary package (including £1100 guaranteed bonuses). would this whole amount £22000 count towards the final salary? or would it be £20900 (which will be lower than minimum value of £23000).

please help...

and finally if the application is rejected after the current visa has expired, could you submit another application in the country or do u have to leave the country and submit a new application through the restricted cos?

new grad is someone who was awarded degree in last 12 months....

forget about bonuses...its irrelevant

your only real question is: are you allowed to pro-rate your salary considering its below 23k! i dont know the answer to that question

you can submit new app, if you have not gone over the 28-day overstay grace period, in country.

I graduated in 2009 but I didn't get the job until 2010.
I had my previous application rejected due to the salary of £20900. In the decision letter they said my wages would be £22392 in 37.5 hours week and it was not above £23000 minimum wage for the job. So my employer has increased my wages to £22000 which equals to £23571 in 37.5 hours week (using the same method as per the decision letter and on the SOC code list). I am so worried now as my current visa has expired (30/11/11) and that application was a last minute job (submitted on 29/11/11)...
I read the case from Richard007 and he successfully got his visa, so I am hoping this will be the case for me.

fingers crossed, i hope they over look this idiotic interpretation of 'new grad' in your case

thanks. i just don't think it is fair to determine a new graduate as 12 months from graduation. it takes time to find a graduation job especially for foreigners. plus if this is a 2 years graduation program, how can they say this is not a new graduate role?

by the time i get the decision for this application, it would have passed 28days..... so i doubt i will get any chance.... it is nice to know that a person went through school, university then got a job paying taxes and they make things as difficult as they can to get you out.

Did your 12 months passed from the 2nd application date? if your 12 month "graduate" period has passed on or before the date of your 2nd application then they might say that you are no longer a graduate and might ask you to find another SOC. I'm only speculating. not trying to scare you...Its best to prepare for the worst so if your results come out negative you have a backup plan.

My first application was in sept 2011 which has long passed the 12 months period. But the decision letter clearly said my salary is not at or above the minimum appropriate rate for the soc code which is £23000. ( which £23000 is referring to the new graduation wage) so I am hoping they are not changing their mind now.

And yes madona587 I agree I should prepare for the worst but I honestly dont know what I can do. My current leave has already expired so the only thing I can do if rejected is to leave the country and apply using an restricted cos? I cant apply an out of time application, can I? I thought it is only acceptable within 28days of the current visa expires? Mine run out on the 30 nov....

I wonder if they now wanted the proper wages which is about 26k, and reject my application....
