Hello,

I hope you can help me, I have been here (UK) for almost 10 years, I got married in Ireland a few weeks ago and now I'd like to sort out my situation.

A little bit about me:

- I'm from Argentina, arrived in the UK on the 30 July 2002, I was given leave to enter for 6 months as a visitor.

- After that I applied for my 1st student visa until 30/10/2003,

- Then the 2nd student visa until 31/10 2004

Later I tried to apply for natuarlization with no luck as for some reason my Father was not born in the UK but abroad (great grand father was), they said no, there was no way.

Then I applied for compasionate reasons to stay because my Mother and Sister are sick they are both British (naturalization), I was waiting for an answer for 5 years, I had to ask for my passport to go back to Argentina for a Family Emergency, they asked if I'd return I said yes; that was March 2009. When I came back I didn't have any problems in the border (I think I was lucky).

A few weeks ago I went to Ireland and I got married with my boyfriend who is Irish but has been living in the UK for several years (more than 20 years). I got all the certificates from Ireland. After the wedding we came back to the UK, there were no problems no one asked for my passport or anything.

Now we are back in the UK and I think that the best way to apply is by a EEA family permit to get a Residence Card?

Please can you help me? as I don't have any UK visa on my passport (they didn't stamp it when I was coming by Ferry), only entries to Spain or Ireland, what do you think? what is my situation?

Can I just simpy sent the EEA 2 Form? As my husband is Irish living and working in the UK.

Do you think they will refuse it because of my actual situation?

What can I do?

Can you please Help me?

Your husband is an Irish citizen exercising treaty rights in the UK.

You are already resident in the UK, so an EEA family permit would not be appropriate, as it is like a form of entry clearance to come to the UK.

Yes, you should now apply on form EEA2 for a residence card.

Your previous immigration history is irrelevant to the EEA2 application.

Your are legally here as the family member of an EEA national exercising treaty rights, so no worries.
