OCI drawback

Post by Park » Tue Oct 03, 2006 5:46 pm

My friend on a visit to India lost his British passport with OCI. Luckily he had a photocopy and expected the British Consular to issue him a new passport. Five months gone and now he has been told that his case has been refered to London to clarify the 'CITIZENSHIP' but meanwhile he should apply for INDIAN citizenship since he has the OCI. He explained but officials are not convinced. Meanwhile he has to report to police station once a week for they don't recognise photo copy. He lost his UK job as well and he is not allowed to work in India. It appears British do not respect the word OCI.

Whether or not he is an OCI is irrelevant to his right to a British passport.

Are you giving us all the information here, or making a serious allegation of malpractise (unjustified denial of a British passport) that should be raised at the highest levels?

Your story is full of holes. OCI has got nothing to do with British citizenship. Why does your friend just not simply present his certificate of naturalisation or other documentary evidence? Surely if he is a naturalised British citizen he must have evidence of the 5+ years he would have had to spend in the UK to obtain it? Why would he have to report to an Indian police station because the British consular officials don't recognise a photocopy of his passport? If your friend genuinely has OCI then he IS allowed to work in India.

I find it highly unlikely that if your friend is a genuine British citizen that he would be denied a passport from the British embassy.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.
