Working as an Agency worker on PSW

Post by bhibhibhi » Tue Sep 20, 2011 8:28 am

Hi

I am on PSW visa which ends on 25 July 2012. I am currently employed by an Agency (contractor) working for a Big Automotive company in UK . I started my contract on 1 June 2011.

My salary is 19 pounds / hour , equating to an equivalent of 36000 pa, My role is a Business Analyst /Financial Analyst.

I would like to enquire from anyone in the know whether it is posible for a REC member Recruitment agency to supply a COS ?

When should I make the application ?

How long does the Tier 2 (Employer sponsored ) normally last ?

I need 3 more years to get 10 year residency .

Please help me with any input that might help.

Yes, if they are in the register of sponsors (or wish to enrol themselves in) and wish to sponsor and employ you.

Are you working as a director of a limited company? Or are you an employee of the recruitment agency in question?

I have just registered myself as a director of a Limited company last week , previously I have been working under the agency name.

My contract with the Automotive firm ends in May 2012 , will I be granted a Tier 2 visa beyond this period , My agency will be happy to have me on working for them .

Does the salary requirement based on a before tax or after tax ?
Please help

Your "sponsored employment" with the agency and the
length of employment / sponsorship" has nothing to do with the "length of contract between your employer and the employer's client" ... unless the employer wishes to sponsor (and employ) you for the duration of the contract.

A sponsoring employer has to provide the details of length of employment / sponsorship when requesting a CoS, and leave is granted accordingly to the applicant.

Does it matter if you work as a director of a limited company or as an employee of the recruitment agency ?

Can you please clarify.

As a director of a limited company, you are an employee of the "limited company". If you wish your "limited company" to sponsor your Tier 2 then (if I remember correctly) you cannot hold more than 10% shares in the limited company ... and your limited company must first apply for inclusion in register of sponsors before they can apply for a CoS for you.

The other option to extend your stay is to find a new job where an employer may be ready to sponsor your employment in UK.

Please help, I cant leave my current job , are they any Umbrella companies that can sponsor me for the COS . I meet all the criteria expect that I do not have a sponsor.

Are they any lawyers in London who specialise in Tier 2 ? Are they any chances of applying under Tier 1 ?
