Sam, you will need to apply for and get a Certificate of Approval to Marry ("CoA").

The form to use can be downloaded by clicking here. You will see from the form that there is an application fee of £135, but in the circumstances you outline there is no reason for the CoA not to be issued.

Once you have your CoA you and your fiancee can go to a designated Register Office and give the needed Notice of Intention to Marry.

Your fiancee? Does she need a CoA? No, because she is an EEA national.

Should it be the intention to get married in (very specifically) a Church of England Church, then do post that information, as the procedure is a bit different.

No, as soon as you are married, that is, you are her family member, you acquire Treaty Rights, as long as she is exercising her Treaty Rights in the UK.

However in order to prove you have Treaty Rights you would need to apply for and get a Residence Card using form EEA2.

But you intend to convert from WP to the EEA route? Are you wanting to change your job? How long have you been in the UK on a WP? Indeed, how long have you been in the UK at all?

yeah John. I have been on work permit since may 2005, and will last till 2009, however i think I can find a better job, if I excercise treaty rights after marriage.

My partner who is german, does she need to complete EEA1 form to be a resident, but she has only been doing temperary work, can she get residency??

I have got few routes
1. wait for wp for 5 years
2. marrying my partner and excercising the rights but for that does my partner needs to be a resident here or have a permanent job???

I hope i m explaining it properly

thanks for all your help.
please advise

You may need to hire an immigration lawyer for the specific advice you appear to need.

Out of interest, do you and your partner intend to have children born in the UK?
