Hello guys,

I have a bit of a long question, so please bear with me...some background first...

I first came into the country in 2003 for study and successfully renewed my visa for a couple of years. I eventually applied for HSMP before the rules changed, however when it came to renewal time, I was denied as I was considered not to meet the new salary requirements, so I was asked to leave the country which I did in May 2007.

I got married in my home country in may 2008 and returned on a spousal visa to the UK and have been working since then. In January 2011, I applied for a review of my rejected HSMP application on the basis of the judicial review and my application was successful. I applied for ILR based on this and I was granted ILR in June 2011 and was given a letter along with my passport stating that my ILR had been backdated to Jan 2010.

I also had a son born in march 2010

My questions are as follows:

Can I apply for a passport for my son? Seeing that technically he was born after the backdated ILR? If I can, what documents do I need to send to IPS as proof?

I believe that I qualify for citizenship, however my fear is that the period I was out of the country (may2007-may2008) will be held against me, because added together my absences will exceed 450days

I'm hoping it will not be held against me because the basis of my ILR was that the period from may 2007 till jan 2011 when I applied for the review will count as time spent in the Uk...so if the folks at the citizenship consider that then I have no problem

Question is will they consider it?

Will it be simpler to just apply for registration mn1 for my son?

I would like to put in my application this month but just need these questions addressed, hope one the experienced guys can shed a light...
