Dear All,
I need an urgent help. My ilr (5-year work permit) application was refused, and the decision letter was dated 16th december 2011, but my solicitor received it on 23rd of 2011, being stupid as he is, he went on vacation.
Now i came to know that i have 10 day time period to appeal, against the refusal.
my solicitor says the 10-business day time period is from the time he received the letter, and i still have time to do that, but it is all not very convincing for me.
please let me know if you know it is true and i still have a chance

Creeksandy, forum etiquette is that you would be better to open a new topic, as it can become muddled as to which question is being answered - the original poster's or yours.

However, if your appeal is late, it can be accepted if there is a reasonable explanation. The fact that most of the country was on holiday for the last two weeks seems reasonable to me for being a little late.


As this is the EEA / EU forum I presumed you referred to an EEA2 Residence card as the non-EEA family member of an EEA national, which is normally valid for five years.

Your topic was unrelated tread. Therefore i decided to split the post and transfer to the appropriate section.

The ten day deadline for lodging an appeal starts from the day the solicitors receives the notice of decision. So you possibly will be fine.

Furthermore, even if you were out of time, provided there are compelling reasons, you could still be allowed by a judge to proceed
