PSw -> Tier 2 (General) without SOC

Hi all

I have submitted the Tier 2 application on 30/12/11 (PSW expired on 31/12/11) without SOC at the time. Will the application be refused if the SOC is submitted this week?

Also, my contract is finished with my company on 29/12/11, can my company issue a SOC to me this week?

do you mean COS?

SOC is different than COS!

your application will be deemed invalid if you dont supply them with COS.

COS is given to applicant by the sponsor (employer)

after they have taken out the fees, they will check your app for the validity and it will be returned back if its not valid

Thanks for your reply.

Yes, it should be CoS. I just wonder if the employer can issue the CoS:

Temp Contract finished on 29/12/11
Application submit on 30/12/11 (without CoS)
PSW expired on 31/12/11

As I am not employed by my current employer, can my company issue the CoS to me this week (say 05/01/12)? Then, I send the CoS number to UKBA?

if your contract with your employer has finished, how can they possibly now issue you with a CoS?

the CoS has nothing to do with validity, an application submitted without a CoS will not be invalid, it will just be refused on points grounds.

Unless your company has given you a new contract just before you applied for your TIER2 with the correct pay according to SOC and providing you with a valid COS. if you apply without a COS you will be refused. No COS means you will lose that 30 points you usually gain switching from PSW like greenie said :roll:

After the contract ended on 29/12/11, there was no new contract issued yet. It looks like a CoS cannot be issued in this case.

well if the contract has ended, and they are no longer employing you or proposing to do so, then they can't issue you a CoS as your sponsor.
