outside UK FLR(O) application!

Dear All,

While ago (November 2011) I posted a thread (shown below) on the unfortunate delay in notifying the Home Office of my change of employer from "A" to "B" January last year leading to the curtailment of my leave to remain from 14 March 2014 to 11 November 2011 by UKBA.

I left UK on the stipulated date (i.e. 11 Nov. 2011) to respect their decision and now I'm trying to follow my case outside UK by submitting a FLR(O) application asking for "further extension of leave" to be able to organize my personal life and perhaps suing my employer in "Employment Tribunal" for not applying on time despite my correspondence with HR and recruiting agency.

I'd be grateful if you can let me know if you think:

1-Do I have an adverse immigration history in my records as of now which might affect any future applications?

2-Is there any other options that I might get back my rights to work in UK?

3-what "Cover Letter Template" should I use for UKBA which I can describe the reasons behind this delay.

any other suggestion is greatly appreciated,

you can't apply for further leave to remain from outside the UK.

I know there are tier1,2,3,4 but can you be more specific which one would be more suitable? As far as I know Tier 1(General) is closed. I can not switch from tier 2 to tier 1.

if you wanna work for an employer , in uk, you need tier 2 general

i listed all the options because i dont know your intentions of coming to uk!

Hesskaz, I went through a very similar situation in 2007 where I moved to a new company and despite giving me assurance about my new work permit, they didn't apply for it. I started working for them and for some reasons it took around 4 months to get my work permit.

After getting the work permit, I sent my passport for the FLR stamping and it got refused. The reason was "breaching of immigration law". Since I started working for the company without receiving a valid WP, my FLR got refused. I mentioned to the home office about the situation where I was forcing my employer to get the work permit and it was on delay from their side but no result. According to home office employer and employee are equally responsibile for making sure that the immigration law is followed. Not knowing a law is not an excuse. So I decided to leave the country. I went back to my home country and with the help of another employer I got a new Work Permit and I came back to UK.

Regarding your questions

1) I believe your immigration history isn't that bad since you left the country at your own expenses and with in the date mentioned but I think since it was a breach of immigration law, you may not be able to enter the country for a year (http://www.ukba.homeoffice.gov.uk/polic ... les/part9/). The experts here would be able to advice you more on this.

2) If you want to work in UK I think Tier 2 is the option.
