flr and income support

Hi everyone,

Am really sorry if am typing this in the wrong section, just I really need some advice regarding my husbands flr, we are soon putting in his application but we got ? fright as someone said cause I am getting income support with incapacity credit that his application will be denied, even though am getting this as if its for ? single person, please help, and am sorry once again, and thankyou in advance

What's your husband's immigration status? Is he working?

Thanks for the rapid response his current work permission are that he works part time and that is through agencies then he gets paid 2 weeks later, his status is that of ? student

Are you living together? Have you declared his income to the benefits agency?how much does he earn?

Yes we are living together and yes they have been informed every relevant parties have been informed, tax credits updated all above board, just worried incase the benefit I am claiming will affect him and his application when he is not benefiting neither claiming it ?

The problem is not that you are claiming benefits but the fact that in you are on income support you probably going to struggle to meet the maintenance requirement. Do you get incapacity benefit of Esa? Do you have children and if so how many?

Well because its been on going cause of illness I have income support with just an incapasity credit attatched to it, I have 3 boys 1 of which. Is disabled and I am the main carer for him I am in receipt of carers allowance and get disability allowance for him

Its income based

The maintenance requirement in your case will be quite complicated to calculate. However i would suggest the following calculation: you need to show that after your rent/mortgage costs and council tax have been deducted you need to show that you and your husband have the following remaining calculated as follows

£105.95 per week which is the income support rate for a couple
plus the incapacity premium of your income support
plus 62.33 per week for each child
Plus the additional amount you get due to your child being disabled and you being his carer

-usually you would need to show £105.95 for a couple and £62.33 for each child per week after rent and council tax are deducted however in your case you need to add the additional amounts you receive due to your incapacity and your child's disability as this is the minimum amount your household needs to live on.

Well I am in receipt of child tax of 211.00 ? week plus 55.10 carers allowance which is taxable, we are not wanting to stay like this in actual fact my husband has ? job position being held for him but he needs the eligibility to work in the country so even though he has ? good job waiting for him as soon as he hands in the papers there's still ? chance they could refuse him ? Please clarify
