Non-EEA national in Germany applying for spouse visa

Hi and a happy new yr to everyone.

I am in a bit of a dilemma at the moment. I am a UK citizen by naturalization and i got married last wk. We also have a 3 month old daughter.

The problem is that my wife is a student in Germany and is originally from Kenya. I realised that inorder for her to apply for the spouse visa they require her to go back to her country of origin.

I was planning on applying for my daughters passport and my wifes visa at the same time.

The question is if the embassy in germany would let as apply from germany instead of going back home or whats the best way to get around this.

No problem. As she is legally resident in Germany she can apply from there.

Thanks for the reply...but if u look at this link they state that some visa categories with temporary permission to stay should go to their home countries.

You're right. I missed the fact that your wife is on a student (temporary) visa.
Another option....are you living and working in Germany at present...or have been during the last 6 months? If so, you have the option of applying for a family permit for your wife under EU rules...which would be free.
