ILR Delay Croydon Docs requested and sent next day no reply

Post by mqsatishmk » Fri Jan 06, 2012 5:01 pm

Hi Team,

I had applied for same day service via solicitor on 20th dec and the home office gave a letter to the solicitor next day on 21st requesting to send the Employer letter confirming that I would be requrired in future and also the SOC code.

I had submitted proof of employment and proof of salary .As the salary was above the minimum threshold of 39000£ of same designation I didnt took it seriously about the SOC code but the HO requested it the next day.I spoke to the Employer and showed the letter given by HO and the Employer gave the letter very next day and posted it on Dec 23rd.

I have asked solicitor to chase HO but no luck as they replied in mail saying the case is under consideration.

Can anyone tell me how long will I have to wait as it is proving very streeful ...

Thanks
Satish

You've probably had no response to your question as no one can tell you how long you'll have to wait. Each case is different. Remember UKBA staff will have been on Christmas leave for much of the time since the requested information was sent to them on the 23rd.
What does your solicitor say??? :?

Hi Casa,

Thanks for the reply. The letter requested for additional employer letter from Home office(HO) said I would need to send the document to HO within 14 days before any decision on my application would be made.

Below is the extract from the letter received from the HO.

Dear Sirs
Re: Mr Satish Kumar Madivalappa Kalasenavaru India 10 April 1982
Thank you for your client's application for leave to remain in the United Kingdom. To help me consider the matter, please send me the following documents. Please send ORIGINAL documents as photocopies are NOT acceptable for the purpose of deciding your application.
Documents required:
1. Please provide a letter from your client's employer confirming that the applicant is still required for the employment and also confirming that the applicant is paid at or above the appropriate rate for the job as stated in the UKBA codes of practice.

To enable the application to be considered fully and prompdy we need all the above documents. It is, therefore, essential that you use the enclosed return label and reply within 14 days. If you fail to provide the required documents, die application will be considered on the basis of the documents that you have already proVided. This may result in your
application being refused in accordance with paragraph 322(9) of the Immigration Rules, that is the failure by an applicant to produce within reasonable time information, documents or other evidence required by the Secretary of State to establish his claim to remain under these rules.
I look forward to hearing from you.

PEO - CROYDON
General Group Managed Migration Directorate

Hope this helps in making clear that I would get an update after 14 working days.

Pls advise

Thanks
Satish

Satish,

My thoughts...the letter from HO seems fairly straight forward that they want SOC code and continuos employment confirmation.

You should have read this forun carefully as it is important to provide this info in employer letter. But I wouldn't be over alrmed here b'coz it seems you have provided them with the rest of the document more or less otherwise they would have asked for more detail.

It is true that it will now be a waiting game but it seems you should be fine if you have provided that requested letter.

Hi Dev,

Thanks for the inputs.

DO you have any idea or remember similar situation in the past from any of the members of this type of situation.

I tried calling the 0870 number option 3 but it doesn't work.Is there any other way to find out the status of the application. Can I walk into the HO to check the status?

If any of the above is not possible can you suggest me when can I seek the MP help to call the HO on behalf of me.

Thanks
Satish

Hi Satish,

I think there is nothing to worry about. One of my colleague he too applied for ILR through Solicitor same day service but the withheld his documents saying that they need to carry out further investigation. He was on work permit and company had issued him Letter as required by HO. As far as i know, they have not made any investigation to the company because i am in a position where i know everything about the enquiry and investigations. They send him his documents and passport endorsed with ILR after 3-4 weeks. so i think its a normal procedure.

Keep faith. you will get good news.

Regards,
RB
